General Terms and Conditions
These General Terms and Conditions (hereinafter also referred to as „GTC„) apply to the sale of tickets, the ticket sales procedure, and to ticket complaints, in connection with the event organised by SILVI PRODUCTION, s. r. o., registered office: Bratislavská 87 902 01 Pezinok, company ID: 45877289, registered in the Commercial Register of the Bratislava I District Court, Section: Sro, Insert no.: 98348/B (hereinafter also referred to as „SILVI PRODUCTION“ or „Organiser„), and are an integral part of any purchase contract concluded between SILVI PRODUCTION or another person acting on behalf of SILVI PRODUCTION (hereinafter also referred to as „Seller„), in the legal capacity of the Seller, and a natural and/or legal person, in the legal capacity of the buyer, the subject of which is the sale of an event ticket by the Seller to the buyer at the purchase price.

Events
The main event is a social event of a cultural nature: the LOVESTREAM FESTIVAL in Bratislava, whose individual events (e.g. concerts, performances, lectures, sports activities, etc.) constitute services related to leisure activities, which the Organiser undertakes to provide to the ticket owner at the agreed time or within the agreed period.
Ticket
The event ticket is a ticket with specific mandatory details such as the place and time of the event, a barcode or a QR code, which allows its holder to enter the event for which it was purchased.
Buyer and ticket owner
The buyer is a natural or legal person who is interested in purchasing tickets for the event and has placed an online ticket order via the Organiser’s e-shop.
The owner of the ticket is a natural person who, in relation to the Organiser, proves that he/she has purchased the ticket for the purpose of eligible participation in the event, provided that he/she has previously concluded a purchase contract with the Seller and has paid the purchase price for the ticket duly and on time.
If the buyer is a natural person, he/she is considered a consumer and the following provisions apply to the given legal relationship (purchase contract) in addition to the provisions of these GTC: the relevant provisions of Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or the Provision of Services under a Distance Contract or a Contract Concluded Outside the Seller’s Premises and on Amendments to Certain Acts, as amended (hereinafter also referred to as the „Act on Consumer Protection in Distance Selling„), Act No. 250/2007 Coll. on Consumer Protection and on Amending the Act of the National Council of the Slovak Republic No. 372/1990 Coll. on Misdemeanours, as amended (hereinafter also referred to as the „Consumer Protection Act„), and Act No. 40/1964 Coll., the Civil Code, as amended. If the buyer is a legal person, the following provisions apply to the given legal relationship (purchase contract) in addition to the provisions of these GTC: the relevant provisions of Act No. 513/1991 Coll., the Commercial Code, as amended.
Purchased tickets may not be returned to the Organiser or exchanged for other tickets, no compensation or discount may be demanded for the purchased tickets from the Organiser, they may not be offered commercially for resale or arbitrarily duplicated in print. In case of loss, damage or theft of the ticket, the Organiser is not obliged to issue a replacement ticket to the buyer.
On entry to the event, each ticket shall be presented to the Organiser for inspection and deactivation; the ticket cannot be subsequently reused for entry to the event. The Organiser shall only allow entry to the event on the basis of a ticket that will be decoded by the relevant decoding device first in the sequence and thus a ticket or a copy of a ticket presented repeatedly will not entitle the person presenting it to enter the event.
A counterfeit ticket, duplicate ticket, ticket without QR code or barcode or otherwise damaged ticket is invalid and, upon presentation of such ticket, the holder will not be allowed to enter the event by the Organiser. Each ticket owner is therefore obliged to protect the ticket against damage, deterioration, loss or forgery.
(Note: a QR code is a two-dimensional code consisting of white and black square modules folded into a square matrix containing encoded ticket information that is designed to be quickly decoded by a dedicated device. After the first validation of the ticket using a QR decoding device, the code is disabled and cannot be used again for the purpose of entering the event.
A barcode is a machine-readable unique ticket marking consisting of thick and thin lines separated by spaces. After the first validation of the ticket by a barcode decoding device, the barcode is disabled and cannot be used again for the purpose of entering the event.)
Purchase, sale of tickets
Tickets for the event can be purchased online, through the e-shop operated by the Organiser on the website www.lovestream.sk.
The Organiser is obliged to accept the ticket order only if the order contains all the data required by the Organiser, in particular the data about the buyer, the object of purchase, the purchase price, the method of payment of the purchase price, and the data necessary for the delivery of the ticket.
By placing an order online, the buyer confirms the truthfulness, correctness and completeness of the data provided therein, the acceptance of the purchase price of the ordered tickets as well as all other terms and conditions of the purchase arising from the order and/or related to the order, in particular the acceptance of these General Terms and Conditions of the Organiser (including the consent to the processing of his/her personal data).
By placing the order, the order becomes binding for the buyer and is considered a proposal for the conclusion of a contract within the meaning of the provision of Section 43a of Act No. 40/1964 Coll., the Civil Code, as amended (hereinafter also referred to as the „CC“), with the possibility of revoking or cancelling this proposal only in the manner set forth in this provision of the CC. Its acceptance by the Organiser leads to the acceptance of the contract proposal, and thus to the conclusion of a purchase contract (at a distance) between the Organiser as the Seller and the person (natural, legal) identified in the order as the buyer, and is thus binding also for the Organiser.
Once the order has been accepted by the Organiser, it is not possible for the buyer to subsequently cancel the order, change the number and/or category of tickets ordered and/or the date of the event.
It is not possible to withdraw from the purchase contract by the buyer as a consumer within the meaning of Section 7(6)(k) of Act No. 102/2014 Coll. on Consumer Protection in the Sale of Goods or the Provision of Services under a Distance Contract or a Contract Concluded Outside the Seller’s Premises and on Amendments to Certain Acts, as amended (hereinafter also referred to as the „Act on Consumer Protection in Distance Selling“ ), as the subject matter of this purchase contract is the provision of services related to leisure activities which the Seller undertakes to provide thereunder at the agreed time or within the agreed period.
The purchase price of tickets is listed on the Organiser’s website above, including details on value added tax.
The purchase price of tickets is final and includes the applicable amount of value added tax in accordance with the legal regulations.
Payment of the purchase price of tickets by the buyer is possible in one of the following ways:
– cashless transfer by payment card via Global Payments.
The costs of using remote means of communication and payment shall be borne by each of the Parties.
The Organiser delivers the ordered ticket to the buyer within the delivery date indicated on its website, otherwise
– not later than one day after the order confirmation by the Organiser, if the ticket is delivered as requested by the buyer via email as a HOMEticket to the buyer’s email address specified in the placed order; or
– if a standard paper ticket is also available, within 5 days of order confirmation, otherwise according to the Organiser’s capacity, if it is a standard paper ticket, by delivery via postal company or courier service to the buyer’s address indicated in the placed order.
When tickets are delivered by post or courier service, a fee for postal transportation is added to the purchase price of the tickets in the amount set by the Seller, according to the method of delivery of the ticket selected by the buyer when filling out the order.
Immediately after the delivery of the ticket, the buyer is obliged to check the accuracy of the ticket data and its condition, later complaints for this reason will not be recognised by the Organiser.
If, in addition to the ticket, the buyer requires a confirmation of the ticket purchase, he/she is obliged to request the Organiser to issue such a confirmation immediately after placing the ticket order, but not later than within seven (14) days after the ticket is delivered to him/her.
Ticket owner’s rights and obligations
The ticket owner is entitled to use the ticket for a single entry to the event for which it was purchased, i.e. he/she is entitled to use the ticket only for the purpose for which it is intended. By presenting the ticket at the entrance to the event, the ticket owner agrees to the Organiser’s instructions at the venue and the conditions attached to and/or related to these instructions.
Restrictions or cancellation of services provided at and/or in connection with the event may occur due to inclement weather, medical condition of the performers, technical problems of the Organiser and its suppliers, safety risks threatening the visitors of the event, etc.
The ticket owner is obliged to present a valid ID card or a severely disabled person card and a ticket to the event at the request of the Organiser or persons authorised by the Organiser.
The ticket owner is obliged to inform him-/herself about the event, its possible changes and cancellations at least on the Organiser’s website or by following the news via public media, and to follow all organisational and safety instructions of the event Organiser at the event, and to comply with all legal regulations. In case of violation of organisational and security instructions of the Organiser by the ticket owner, as well as in case of violation of legal regulations by the ticket owner, the Organiser reserves the right to expel the ticket owner from the event venue without any compensation or restrict his/her movement at the event venue. The Organiser’s claim for damages against the ticket owner is not affected thereby.
By concluding the purchase contract, the ticket owner grants the Organiser and any third parties his/her consent, without entitlement to any consideration, to the production, publishing, sharing of recordings in any format (likeness, photographs, video and audio recordings) made at or in connection with the event, for artistic purposes, for advertising purposes of the Organiser or the event partners, and for press, radio and television coverage.
Organiser’s rights and obligations
The Organiser reserves the right to change the scope of the event as well as to cancel the event without any claim of the ticket owners/buyers against the Organiser for a discount or refund of the ticket purchase price or reimbursement of any expenses related to their participation in the event (e.g. accommodation, travel, meals, etc.), or any claim for compensation for damage incurred by the ticket owners/buyers for this reason, in particular in the event of bad weather and/or threat of a terrorist attack, order of the competent public authorities, or the existence of any other risk to the health, lives or extensive material damage to the property of third parties.
The Organiser shall publish information about the cancellation of the event or a change in the scope of the event as soon as the fact and/or circumstance giving rise to the cancellation of the event occurs.
The Organiser shall not be liable to the buyers/ticket owners for any damage caused as a result of or in connection with the delay of the event, cancellation (non-occurrence) of the event for the reasons stated above or other changes relating to the event.
The Organiser shall not be liable to buyers for incorrect printing of tickets by buyers, for non-delivery of tickets via postal company and/or courier service due to incorrect and/or incomplete delivery data entered in the order, due to the postal company and/or courier service’s fault, or due to the fact that the addressee is unknown, or not present at the delivery address at the time of delivery.
If the festival is cancelled at any time before the start date (min. 1 calendar day before the opening of the gates), for any reason, the ticket holder shall be refunded the full amount for which the ticket was purchased, unless the ticket holder decides to keep the ticket and use it in the following year’s edition. In the event that the next edition of the festival does not take place, the full amount of the ticket shall be refunded to the ticket holder.
Complaints, grievances and suggestions of buyers
In connection with complaints, buyers/ticket owners are obliged to proceed in accordance with the Act on Consumer Protection in Distance Selling, the Consumer Protection Act, or other relevant legal regulations, in particular the CC and the Commercial Code.

Instruction on the Seller’s liability for defects
The Seller is liable for defects within the meaning of the relevant legal regulations, in particular the CC, the Commercial Code.
Privacy policy
By placing an online ticket order via the Organiser’s e-shop, the buyer expresses, within the meaning of the relevant provisions of Act No. 122/2013 Coll. on the Protection of Personal Data and on Amendments to Certain Acts, as amended (hereinafter also referred to as the „Personal Data Protection Act“), his/her consent to the processing of personal data provided in the order by the Organiser, or a third party authorised by the Organiser for the purpose of processing the order and fulfilling the Organiser’s obligations as a Seller under the purchase contract, and for the purpose of further communication with the buyer, for a limited period of time, until the purpose of processing the buyer’s personal data is fulfilled. After the purpose of processing the personal data of the buyer has been fulfilled, the Organiser shall ensure the immediate destruction of the buyer’s personal data. Consent to the processing of personal data may be revoked by the buyer at any time in writing at the address of the Organiser’s registered office.
Information on the possibility and conditions for resolving a dispute through the alternative dispute resolution system
If the buyer-consumer was not satisfied with the handling of a complaint by the Organiser, or if the buyer-consumer contacted the Organiser with a request for redress and was not satisfied with the manner in which the Organiser has handled his/her complaint, or if he/she believes that the Organiser has violated his/her rights, the buyer-consumer has the right to contact the Organiser with a request for redress. If the Organiser responds to such a request in a negative manner or fails to respond within 30 days from the date of its dispatch, the buyer-consumer has the right to lodge a proposal for the initiation of an alternative dispute resolution to an alternative dispute resolution body. The alternative dispute resolution body is the Slovak Trade Inspection, Prievozská 32, P.O. Box 5, 820 07 Bratislava 27, or another competent authorised legal person registered in the list of alternative dispute resolution bodies maintained by the Ministry of Economy of the Slovak Republic (the list is available at www.mhsr.sk). The buyer-consumer is entitled to choose the alternative dispute resolution body to apply to. Consumers can use the online dispute resolution platform available at http://ec.europa.eu/consumers/odr/ to lodge a proposal for alternative dispute resolution.
Final provisions
The Organiser is entitled to amend these General Terms and Conditions. The Organiser is obliged to publish the amended General Terms and Conditions on its website www.lovestream.sk at the latest on the effective date of the change.
Legal relations related to the sale of tickets for the event are subject to the relevant legal regulations, in particular the Act on Consumer Protection in Distance Selling, the Consumer Protection Act, the CC, the Commercial Code.
These GTC shall enter into force and effect on 21 November 2022.
