General Terms and Conditions


These General Terms and Conditions (hereinafter the "T&C") govern the rights and obligations of the contracting parties arising from a distance purchase contract concluded between the seller and the buyer, the subject of which is the purchase of tickets, beverage vouchers, and related services for an event organized by Lovestream Events, a. s., with registered office at: Laurinská 8, Bratislava – Staré Mesto district 811 01, Company ID (IČO): 57 289 018, Tax ID (DIČ): 2122659407, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sa, Insert No.: 7869/B, e-mail: info@lovestream.sk (hereinafter also referred to as "Lovestream Events, a. s." or the "organizer"). These T&C form an integral part of every purchase contract concluded between Lovestream Events, a. s. (or another person acting in its name) in the legal position of seller (hereinafter also the "seller") and a natural and/or legal person in the legal position of buyer, the subject of which is the sale of a ticket, beverage voucher, or other products for an event organized by the seller for a purchase price paid by the buyer.


Events

The main event is the cultural social event: LOVESTREAM FESTIVAL (hereinafter the "event"), whose individual activities (e.g., concerts, performances, lectures, sporting activities, etc.) represent leisure-time related services that the organizer undertakes to provide to the ticket holder at a time and place determined by the organizer. The festival organizer bears no responsibility for any damages, losses, or other inconveniences caused by cancellation, delay, or change of the program due to the conduct of a performer and/or for reasons of so-called force majeure, including changes resulting from measures adopted in connection with ensuring the safety of event visitors and preventing property damage. This includes in particular the cancellation or delay of a performance, cancellation or change of program, as well as other program changes caused by the aforementioned circumstances. The organizer bears no responsibility for financial losses or other inconveniences incurred by participants as a result of these changes.


Ticket and Beverage Voucher

The organizer sells the following own products through its e-shop:

Ticket: A ticket for the event is a security document with specific mandatory particulars such as the place and time of the event, a barcode or QR code, which allows its holder entry to the event for which it was purchased.

Beverage voucher: A beverage voucher (hereinafter the "beverage voucher") is an electronic document purchased through the organizer's e-shop, which entitles its holder to redeem non-alcoholic and/or alcoholic beverages at the festival in the value or scope specified on the voucher. The beverage voucher may be used exclusively during the course of the relevant event (festival) for which it was purchased. After the event ends, the voucher's validity expires without compensation, and unused credit or unused beverages cannot be reimbursed or refunded retroactively. A beverage voucher entitling the holder to redeem alcoholic beverages may only be purchased and used by a person who, at the time of purchase and redemption, has reached at least 18 years of age.


Buyer, Ticket Holder, and Beverage Voucher Holder

Buyer: A natural or legal person who is interested in purchasing tickets/beverage vouchers and has purchased a ticket, or possibly also a beverage voucher, for the event and has sent an online order for tickets/beverage vouchers through the organizer's e-shop or possibly through another platform.

Ticket holder/beverage voucher holder is a natural person who, in relation to the organizer, presents a purchased ticket for the purpose of authorized participation in the event or a purchased beverage voucher, provided that a purchase contract has previously been concluded with the seller and the purchase price has been paid properly and on time.

If the buyer is a natural person who does not conclude the purchase contract in the course of business activity, they are considered a consumer. This legal relationship is governed by the provisions of Act No. 108/2024 Coll. on Consumer Protection and on Amendments to Certain Acts and Act No. 40/1964 Coll., the Civil Code. If the buyer is an entrepreneur, the relationship is governed by Act No. 513/1991 Coll., the Commercial Code. Purchased tickets and beverage vouchers cannot be returned to the organizer, nor exchanged for others; likewise, no other compensation or discount may be claimed.

Pursuant to § 19 par. 1 letter l) of Act No. 108/2024 Coll. on Consumer Protection and on Amendments to Certain Acts, the consumer does not have the right to withdraw from a contract whose subject is the purchase of a ticket, since the subject of the contract is the provision of leisure-time related services which the seller undertakes to provide at a precisely agreed time (during the course of the festival). For purchased beverage vouchers, the consumer has the right to withdraw from the contract without stating a reason within 14 days from the date of conclusion of the contract (purchase of the voucher). However, this right of withdrawal expires for the consumer at the moment the event (festival) for which the beverage voucher was purchased begins, or at the moment the voucher is redeemed (used) at the event before the 14-day period expires.

When exercising the right of withdrawal, the consumer shall inform the organizer of their decision to withdraw from this contract by an unambiguous statement (for example, a letter sent by post or by e-mail) to the address: Business name: Lovestream Events, a. s. The provisions of these T&C governing consumer rights (in particular the right to withdraw from the contract within 14 days and the special complaints regime) do not apply to buyers who are entrepreneurs and conclude the contract within the scope of their business activity.

It is prohibited to offer tickets and beverage vouchers for commercial resale or to arbitrarily print duplicates of them, or to make visual modifications to them or to the elements they contain. In the event of loss, damage, or theft of a ticket, the organizer is not obliged to issue the buyer a replacement ticket or a replacement beverage voucher.

Upon entry to the event, each ticket is presented to the organizer for inspection and may be deactivated by the organizer (note: in the case of single-entry admission); the ticket cannot subsequently be used again for entry to the event. The organizer will allow entry to the event only on the basis of the ticket that is decoded as the first in order by the relevant decoding device, and thus a repeatedly presented ticket or a copy of a ticket will not entitle the person presenting it to entry to the event.

A forged ticket, duplicate ticket, ticket without a QR code or barcode, or an otherwise damaged ticket is invalid, and its holder will not be permitted entry to the event by the organizer upon presentation of such a ticket. After the first verification of the ticket's validity using the QR decoding device or barcode, the code is deactivated and its further use for the purpose of entry to the event is not possible. A QR code is a two-dimensional code composed of white and black square modules arranged in a square matrix, containing encoded information about the ticket, designed for rapid decoding using a designated device. A barcode is a machine-readable unique marking of the ticket consisting of thick and thin lines separated by spaces. Every ticket holder is therefore obliged to protect the ticket from damage, deterioration, loss, or forgery.


Purchase, Sale of Tickets and Beverage Vouchers, and Conditions of Performance

Tickets and beverage vouchers for the event can be purchased online, through the e-shop operated by the organizer at the website www.lovestream.sk, or, in the case of tickets, through contractual partners carrying out ticket sales depending on availability.

The organizer is obliged to accept an order for a ticket/beverage voucher only if the order contains all the data required by the organizer, in particular data about the buyer, the subject of the purchase, the purchase price, the method of payment of the purchase price, and the data necessary for delivery of the ticket/beverage voucher.

By submitting the order online, the buyer confirms the truthfulness, correctness, and completeness of the data provided therein, acceptance of the purchase price of the ordered tickets/beverage vouchers, as well as all other conditions of purchase arising from and/or related to the order, in particular consent to these general terms and conditions of the organizer (the processing of personal data is governed by a separate document, the "Privacy Policy").

By submitting the order, the order becomes binding for the buyer and is considered a proposal to conclude a contract within the meaning of § 43a of Act No. 40/1964 Coll., the Civil Code, as amended (hereinafter also "CC"), with the possibility of revoking this proposal or cancelling it only in the manner set out in this provision of the CC. Its acceptance by the organizer results in acceptance of the contract proposal and thereby the conclusion of a (distance) purchase contract between the organizer as seller and the person more specifically identified in the order (natural, legal) as buyer, and is thus also binding for the organizer.

After the order has been accepted by the organizer, it is not possible for the buyer to subsequently cancel the order, change the number and/or category of ordered tickets/beverage vouchers, and/or the date of the event, unless otherwise provided by applicable legal regulations.

A condition for performance by the organizer is the proper conclusion of the purchase contract and payment of the purchase price for the ticket and/or beverage voucher properly and on time.

The buyer, as a consumer, cannot withdraw from the purchase contract whose subject is the purchase of tickets pursuant to § 19 par. 1 letter l) of the Consumer Protection Act, since the subject of this contract is the provision of leisure-time related services which the seller undertakes to provide at a precisely agreed time or within a precisely agreed period (during the course of the event). The consumer's right to withdraw from the contract for the purchase of beverage vouchers within 14 days (under the conditions set out in these T&C) remains unaffected by this.

The purchase price of tickets/beverage vouchers is final and stated on the organizer's website mentioned above, including value added tax information.

Payment of the purchase price of tickets/beverage vouchers by the buyer is possible by one of the following methods (if available on the relevant platform at the relevant time):

  1. by bank transfer to the organizer's and/or a third party's bank account,
  2. through a payment gateway.

Payments are processed securely through a licensed payment service provider. The buyer acknowledges and agrees to the general terms and conditions of the relevant payment gateway provider. Before completing the order, the buyer confirms that they have familiarized themselves with and agree to the T&C of the relevant payment gateway provider and to the processing of personal data (GDPR) by the payment gateway provider. When paying by card, the buyer acknowledges and agrees to the general terms and conditions for the acceptance of payment cards of the relevant payment gateway provider.

Each contracting party bears the costs of using means of distance communication and payment separately.


Special Conditions for the Sale and Serving of Alcoholic Beverages via a Purchased Beverage Voucher

In accordance with Act No. 219/1996 Coll. on Protection against Abuse of Alcoholic Beverages and on the Establishment and Operation of Sobering-up Facilities, it is prohibited to sell or serve alcoholic beverages to persons under 18 years of age. By submitting an order for a beverage voucher that includes alcoholic beverages, the buyer declares on their honor that, at the time of submitting the order, they have reached at least 18 years of age.

When redeeming (exchanging) a beverage voucher for an alcoholic beverage at the event venue (festival), the organizer's staff or a person authorized by the organizer is entitled and obliged to verify the age of the voucher holder by presenting a valid identity document (identity card, passport). If the beverage voucher holder fails, upon request, to prove their identity with a valid document showing they have reached 18 years of age, or if it is shown that the holder has not reached 18 years of age, the organizer is obliged to refuse to issue the alcoholic beverage.

In the event of refusal to issue an alcoholic beverage under the preceding point, the buyer or voucher holder is not entitled to a refund of the voucher's purchase price, a discount, or any other financial compensation. The organizer may (but is not obliged to) issue the voucher holder a non-alcoholic beverage of equivalent value instead of the alcoholic beverage.


Delivery of Tickets

The organizer delivers the ordered ticket to the buyer within the delivery period stated on its website, otherwise: a) no later than one (1) day from confirmation of the order by the organizer, if the ticket is delivered, at the buyer's request, by e-mail as a so-called HOMEticket to the buyer's e-mail address stated in the order, or b) within five (5) days from confirmation of the order by the organizer, if a standard paper ticket is available in the offer and the buyer has chosen this method, delivered via a postal service provider or courier service to the delivery address stated in the order. For this method of delivery, a postage fee in the amount set by the organizer is added to the purchase price.

Immediately after delivery of the ticket, the buyer is obliged to check the accuracy of the data on it and its correctness (in particular the date, time, entry category, and legibility of the QR/barcode). Defects claimed later for this reason may not be accepted by the organizer.

The organizer is not liable for incorrect printing of tickets by the buyer, nor for non-delivery of a paper ticket by post or courier due to incorrect or incomplete data entered in the order, or due to a fault of the postal service provider or courier service.


Delivery of Beverage Vouchers

The organizer delivers the ordered beverage voucher to the buyer exclusively in electronic form as a so-called e-voucher.

The organizer shall deliver the e-voucher no later than one (1) day from confirmation of the order (crediting of payment to the organizer's account), in PDF format or another suitable electronic format, to the buyer's e-mail address stated in the order. Delivery of beverage vouchers by post or courier service is not possible unless the organizer expressly determines otherwise.

Immediately after delivery of the beverage voucher, the buyer is obliged to check the accuracy of the data on it (in particular the credit value, type of beverages, and legibility of the QR/barcode). Defects claimed later for this reason may not be accepted by the organizer.

The organizer is not liable for non-delivery of the beverage voucher to the buyer's e-mail address if the buyer provided an incorrect, incomplete, or inactive e-mail address, if the e-mail message was delivered to the buyer's junk/spam folder, or if delivery was prevented by a technical setting of the buyer's mailbox (e.g., a full mailbox).


Rights and Obligations of the Ticket Holder

The ticket holder is entitled to use the ticket for entry to the event for which it was purchased, i.e., is entitled to use the ticket only for the purpose for which it is intended. By presenting the ticket upon entry to the event, the ticket holder expresses their consent to the organizer's instructions at the event venue and the conditions attached to and/or related to these instructions. The ticket holder is obliged, upon request by the organizer or persons authorized by it, to present a valid identity document or a disability card, as applicable, and the ticket for the event.

Restriction or cancellation of services (program) provided at and/or in connection with the event may occur due to adverse weather conditions, the health condition of performers, technical problems of the organizer and its suppliers, security risks threatening event visitors, and similar circumstances.

The ticket holder is obliged to keep informed about the event, its possible changes, and cancellation at least via the organizer's website or by following developments through public-service media, and to comply at the event with all organizational and safety instructions of the event organizer and to observe all legal regulations. In the event of a breach of the organizer's organizational and safety instructions by the ticket holder, as well as in the event of a breach of legal regulations by the ticket holder, the organizer reserves the right to remove the ticket holder from the event venue without entitlement to any compensation, or to restrict their movement at the event venue. The organizer's right to compensation for damages against the ticket holder remains unaffected by this.

By concluding the purchase contract, the ticket holder grants the organizer, as well as any third parties, without entitlement to any consideration, consent to the creation, publication, and dissemination of any form of recording (likeness, image, audiovisual recording) made at or in connection with the event, for artistic purposes, for the organizer's or event partners' advertising purposes, and for press, radio, and television news reporting.


Special Fee Obligations of the Ticket Holder and Fees

Handling Fee:

Lovestream Events, a.s. provides Ticket Holders with a service for the storage and subsequent handling of Tickets, which ensures that the Ticket is permanently stored in the System and will be accessible to the Ticket Holder who proves their identity and ownership of the Ticket to Lovestream Events, a.s., in the event that, for example, the Ticket Holder’s account on the lovestream. eventhub.fm, or if that account becomes unavailable to the Ticket Holder for any other reason, or if the Ticket Holder loses or cannot access their Tickets for any other reason (loss or deletion of the email containing the Tickets, etc.).

Lovestream Events, a.s. is entitled to charge the Ticket Holder, and the Ticket Holder is obligated to pay Lovestream Events, a.s. a separate fee for the service of archiving and subsequently managing the Tickets in the System. The fee for archiving the Ticket will be charged together with the Ticket price at the time of purchase.


Third-Party Services (Accommodation)

Service provider: The sale of accommodation capacity on the organizer's website is brokered and provided directly by the travel agency ETN Slovakia spol. s r.o., with registered office at Tupého 23/A, Bratislava 831 01, Company ID (IČO): 31 379 508, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, Insert No.: 7591/B (hereinafter "ETN Slovakia").

Contractual relationship: By submitting an accommodation order through the integrated widget (iframe), a contractual relationship arises directly between the customer and ETN Slovakia in accordance with their General Terms and Conditions. Lovestream Events, a. s. is not a party to this relationship and is not responsible for the quality of the accommodation, payments for the accommodation, or the handling of any complaints related to the accommodation.

Payments: Payments for accommodation are processed directly by ETN Slovakia through their payment gateway (WorldPay / Global Payments).

Delivery of vouchers: Accommodation vouchers are generated after successful payment and are sent by ETN Slovakia directly to the main customer's e-mail address.

Accommodation complaints: Any complaints, requests for changes, or cancellations of accommodation must be made directly with the provider, ETN Slovakia spol. s r.o.


Rights and Obligations of the Organizer

The organizer reserves the right to change the scope of the event as well as to cancel the event during its course (for objective and relevant reasons) without any entitlement on the part of ticket holders/buyers against the organizer to a discount or refund of the ticket purchase price or compensation for any expenses connected with their participation in the event (such as accommodation, travel, meals, etc.), or entitlement to compensation for damages arising from this for ticket holders/buyers, in particular, but not exclusively, in the event of adverse weather and/or the threat of a terrorist attack, an order by relevant public authorities, or the existence of another risk threatening health, life, or extensive material damage to third-party property; or as a result of changes on the part of performing artists.

The organizer is entitled to publish information about the cancellation of the event or a change in the scope of the event without delay after the fact and/or circumstance giving rise to such action occurs.

The organizer is not liable to buyers/ticket holders for damages caused by or in connection with a delay of the event, cancellation (non-occurrence) of the event for the reasons stated above, or other changes relating to the event.

If the festival is cancelled at any time before the day it begins (at least 1 calendar day before the opening of the entry gates), for any reason whatsoever, the ticket holder will be refunded the full amount paid for the ticket, unless the ticket holder decides to keep it and use it for the following year's edition (note: if such an offer is made by the organizer).


Complaints, Grievances, and Suggestions from Buyers

Complaints relating to the purchase of tickets and beverage vouchers may be lodged in writing at the organizer's registered office address or by e-mail to: info@lovestream.sk. When lodging a complaint, proof of purchase and the purchased ticket/beverage voucher must be submitted. The organizer will handle the complaint in accordance with the Consumer Protection Act.

For grievances and suggestions, the organizer may be contacted by e-mail at: info@lovestream.sk or in writing at the address: Lovestream Events, a. s., Laurinská 8, Bratislava – Staré Mesto district 811 01.

Complaints relating to accommodation, accommodation payments, or accommodation vouchers must be lodged directly with the provider, ETN Slovakia spol. s r.o., at the contact addresses stated in their terms and conditions.


Notice on the Seller's Liability for Defects

The organizer is responsible for ensuring that the services (event) are provided in accordance with the contract. If the provided service has defects (e.g., the event did not take place on time or to the agreed extent), the consumer has the right to lodge a complaint. The consumer has the right to free remedy of the defect, a reasonable discount on the price, or, in the case of a serious defect that cannot be remedied and which prevents proper use of the service, the right to withdraw from the contract in accordance with § 624 of the Civil Code.


Personal Data Protection

The processing of the buyer's personal data for the purposes of handling the order and performing the purchase contract is carried out on the legal basis of contract performance in accordance with the GDPR regulation and Act No. 18/2018 Coll. Detailed information on the buyer's rights is set out in the Privacy Policy on the organizer's website.


Information on the Possibility and Conditions of Dispute Resolution through the Alternative Dispute Resolution System

If the buyer – consumer is not satisfied with the resolution of a complaint or believes that the organizer has violated their rights, they have the right to turn to the organizer with a request for redress. If the organizer rejects the request or fails to respond within 30 days, the consumer has the right to submit a proposal to initiate alternative dispute resolution to an ADR entity. The competent entity is the Slovak Trade Inspection (SOI) (www.soi.sk) or another authorized legal entity listed in the register maintained by the Ministry of Economy of the Slovak Republic.


Final Provisions

The organizer is entitled to amend and supplement these terms and conditions. The organizer is obliged to always publish the amended terms and conditions on its website www.lovestream.sk no later than the date on which the amendment takes effect.

Legal relationships related to the sale of tickets and beverage vouchers for the event are additionally governed by the relevant legal regulations, in particular the Consumer Protection Act, the Civil Code, and others.

Personal data protection and the use of cookies are governed by separate documents, the "Privacy Policy" and "Cookies," available on the organizer's website.
