General Terms and Conditions

These terms and conditions (hereinafter also referred to as "TC") apply to the sale and procedure for selling tickets and their complaints in connection with the event organised by the company LOVESTREAM, s. r. o., with its registered office at Bratislavská 87, 902 01 Pezinok, Company ID: 55 885 446, registered in the Commercial Register of the Municipal Court Bratislava III, Section: Sro, File No.: 174136/B (hereinafter also referred to as "LOVESTREAM, S. R. O." or "Organiser") and form an integral part of every purchase contract concluded between LOVESTREAM, s. r. o., or another person acting on its behalf (hereinafter also referred to as "Seller"), in the legal position of the seller and a natural and/or legal person in the legal position of the buyer, the subject of which is the sale of one or more tickets for the event organised by the Seller to the Buyer for the purchase price.

Events


The main event is a social event of a cultural nature: LOVESTREAM FESTIVAL, whose individual activities (such as concerts, performances, lectures, sports activities, etc.) represent services related to leisure activities, which the Organiser undertakes to provide to the ticket holder at the time and place determined by the Organiser.

The festival Organiser is not responsible for any damages, losses or other inconveniences caused by the cancellation, delay or change of the programme due to the actions of the performer and/or due to force majeure, including changes resulting from measures taken in connection with ensuring the safety of event visitors and preventing damage to property. This includes, but is not limited to, cancellation of a performance or programme, delay of a performance or programme; or other changes to the programme caused by the aforementioned circumstances. The Organiser is not responsible for financial losses or other inconveniences incurred by participants as a result of these changes.


Ticket


A ticket for the event is a document of value with specific mandatory requirements such as the venue and time of the event, barcode or QR code, which allows its holder entry to the event for which it was purchased. The ticket is non-transferable.


Buyer and Ticket Holder


The Buyer is a natural or legal person who is interested in purchasing tickets and has purchased one or more tickets for the event and has submitted an online ticket order through the Organiser's e-shop or through other platforms.

The ticket holder is a natural person who presents a purchased ticket to the Organiser for the purpose of legitimate participation in the event, provided that a purchase contract with the Seller has been previously concluded and the purchase price for the ticket has been paid properly and on time.

If the Buyer is a natural person who does not conclude the purchase contract in the course of their business activities, they are considered a consumer and, in addition to the provisions of these TC, the relevant provisions of Act No. 108/2024 Coll. on Consumer Protection and on the amendment of certain acts as amended (hereinafter also referred to as the "Consumer Protection Act") and Act No. 40/1964 Coll. Civil Code as amended shall apply to the given legal relationship (purchase contract). If the Buyer is a legal person or a natural person – entrepreneur, in addition to the provisions of these TC, the relevant provisions of Act No. 513/1991 Coll. Commercial Code as amended shall apply to the given legal relationship (purchase contract).

Purchased tickets cannot be returned to the Organiser, nor exchanged for other tickets, nor can any other compensation or discount be requested from the Organiser for purchased tickets. It is prohibited to commercially offer tickets for resale or to arbitrarily print their duplicates or to make visual modifications to them and their elements. In the event of loss, damage or theft of a ticket, the Organiser is not obliged to issue a replacement ticket to the Buyer.

Upon entry to the event, each ticket is presented to the Organiser for inspection and may be deactivated by the Organiser (note: in the case of one-time entry); the ticket cannot subsequently be reused for entry to the event. The Organiser will allow entry to the event only on the basis of the ticket that is decoded first by the relevant decoding device, and therefore a repeatedly presented ticket or a copy of a ticket will not entitle the person presenting it to entry to the event.

A forged ticket, duplicate ticket, ticket without a QR code (note: a QR code is a two-dimensional code consisting of white and black square modules arranged in a square matrix containing encoded information about the ticket, designed for rapid decoding using a dedicated device; after the first verification of the ticket's validity using a QR decoding device, the code is deactivated and its further use for the purpose of entry to the event is not possible) or barcode (note: a barcode is a machine-readable unique ticket identifier consisting of thick and thin lines separated by spaces; after the first verification of the ticket's validity using a barcode decoding device, the code is deactivated and its further use for the purpose of entry to the event is not possible) or otherwise damaged ticket is invalid and its holder will not be permitted entry to the event by the Organiser upon presentation of such a ticket. Every ticket holder is therefore obliged to protect the ticket from damage, defacement, loss or forgery.


Purchase and Sale of Tickets


Tickets for the event can be purchased online through the e-shop operated by the Organiser at www.lovestream.sk or through contractual partners carrying out ticket sales, subject to availability.

The Organiser is obliged to accept a ticket order exclusively if the order contains all data required by the Organiser, in particular data about the Buyer, the subject of purchase, the purchase price, the method of payment and the data necessary for ticket delivery.

By submitting an online order, the Buyer confirms the truthfulness, correctness and completeness of the data stated therein, acceptance of the purchase price of the ordered tickets as well as all other purchase conditions arising from and/or related to the order, in particular consent to these terms and conditions of the Organiser (including consent to the processing of their personal data and other consents according to the conditions set out in the "GDPR" section).

By submitting the order, the order becomes binding for the Buyer and is considered a proposal to conclude a contract pursuant to Section 43a of Act No. 40/1964 Coll. Civil Code as amended (hereinafter also referred to as "CC") with the possibility of revoking or cancelling this proposal only in the manner specified in this provision of the CC. Upon its acceptance by the Organiser, the contract proposal is accepted and thus a purchase contract (distance contract) is concluded between the Organiser as the Seller and the person more closely identified in the order (natural or legal person) as the Buyer, and is thus also binding for the Organiser.

After the order is accepted by the Organiser, it is not possible for the Buyer to subsequently cancel this order, change the number and/or category of ordered tickets and/or the date of the event, unless otherwise provided by applicable legal regulations.

The Buyer as a consumer cannot withdraw from the purchase contract pursuant to the Consumer Protection Act, as the subject of this purchase contract is the provision of services related to leisure activities, according to which the Seller undertakes to provide these services at the agreed time or within the agreed period.

The purchase price of tickets is final and stated on the Organiser's website mentioned above, including value added tax information.

Payment of the purchase price for tickets by the Buyer is possible by one of the following methods (if available on the relevant platform at the given time):



The costs of using remote communication and payment means are borne by each contracting party separately.

The Organiser delivers the ordered ticket to the Buyer within the delivery period stated on its website, otherwise:



When delivering tickets by post or courier service, a postal delivery fee in the amount determined by the Seller is added to the purchase price of the tickets, according to the delivery method chosen by the Buyer when filling in the order.

Immediately after delivery of the ticket, the Buyer is obliged to check the correctness of the ticket data and its integrity; defects reported later for this reason may not be accepted by the Organiser.

The Organiser is not responsible to Buyers for incorrect printing of tickets by Buyers, for non-delivery of tickets via postal service and/or courier service due to the entry of incorrect and/or incomplete data necessary for delivery of the shipment in the order, due to an error of the postal service and/or courier service, or due to the fact that the addressee is unknown or is not present at the delivery address at the time of delivery.

If the Buyer requires, in addition to the ticket, the preparation of another confirmation of the ticket purchase, they are obliged to request the Organiser to prepare such confirmation immediately after submitting the ticket order, but no later than seven (14) days after the ticket is delivered to them.


Rights and Obligations of the Ticket Holder


The ticket holder is entitled to use the ticket for entry to the event for which it was purchased, i.e. they are entitled to use the ticket only for the purpose for which it is intended. By presenting the ticket upon entry to the event, the ticket holder expresses their consent to the Organiser's instructions at the event venue and the conditions that relate to and/or are associated with these instructions. The ticket holder is obliged, upon request by the Organiser or persons authorised by the Organiser, to present a valid identity document, possibly a disability card, and the ticket for the event.

Services (programme) provided at the event and/or in connection with the event may be restricted or cancelled due to adverse weather conditions, the health condition of performers, technical problems of the Organiser and its suppliers, security risks threatening event visitors, etc.

The ticket holder is obliged to stay informed about the event, any changes to it and its cancellation at least on the Organiser's website or by following developments through public media, and to comply with all organisational and safety instructions of the event Organiser at the event and to observe all legal regulations. In the event of a violation of the Organiser's organisational and safety instructions by the ticket holder, as well as in the event of a violation of legal regulations by the ticket holder, the Organiser reserves the right to expel the ticket holder from the event venue without any claim to compensation, or to restrict their movement at the event venue. The Organiser's claim for damages against the ticket holder remains unaffected.

By concluding the purchase contract, the ticket holder grants the Organiser as well as any third parties, without any claim to compensation, consent to the creation, publication and distribution of any form of recording (likeness, image, audio and video recording) made at the event or in connection with it, for artistic purposes, advertising purposes of the Organiser or event partners, and for press, radio and television reporting.


Rights and Obligations of the Organiser


The Organiser reserves the right to change the scope of the event as well as to cancel the event during its course (for objective and relevant reasons) without any claim of ticket holders/Buyers against the Organiser for a discount or refund of the ticket purchase price or compensation for any expenses associated with their participation in the event (such as accommodation, travel, meals, etc.), or a claim for damages arising for this reason to ticket holders/Buyers, particularly but not exclusively in the case of adverse weather and/or threat of a terrorist attack, orders of the relevant public authorities, or the existence of another risk to health, lives or extensive material damage to the property of third parties; or as a result of changes on the part of performing artists.

The Organiser is entitled to publish information about the cancellation of the event or a change in the scope of the event immediately after the fact and/or circumstance that is the reason for such action occurs.

The Organiser is not liable to Buyers/ticket holders for damages caused as a result of or in connection with the delay of the event, cancellation (non-occurrence) of the event for the reasons stated above, or other changes relating to the event.

In the event that the festival is cancelled at any time before the day of its commencement (min. 1 calendar day before the opening of the entrance gates), for any reason, the ticket holder will be refunded the full amount for which they purchased the ticket, unless the ticket holder decides to keep it and use it for the following year (note: in the case of such an offer from the Organiser).


Complaints, Grievances and Suggestions from Buyers


In connection with complaints, Buyers/ticket holders are obliged to proceed in accordance with the Consumer Protection Act or other relevant legal regulations, in particular the Civil Code. Claims may only be made with concurrent proof of the completed purchase.

Information on the Seller's Liability for Defects


The Seller is liable for defects in accordance with the relevant legal regulations, in particular the Civil Code and the Commercial Code.


Personal Data Protection


By submitting an online ticket order through the Organiser's e-shop, the Buyer expresses, in accordance with the relevant provisions of Act No. 18/2018 Coll. on the Protection of Personal Data and on the amendment of certain acts as amended (hereinafter also referred to as the "Personal Data Protection Act"), their consent to the processing of personal data stated in the order by the Organiser or a third party authorised by the Organiser for the purposes of processing the order and fulfilling the Organiser's obligations as the Seller under the purchase contract and further communication with the Buyer, for a definite period, until the purpose of processing the Buyer's personal data is fulfilled. After the purpose of processing the Buyer's personal data is fulfilled, the Organiser will ensure the prompt disposal of the Buyer's personal data. The Buyer may withdraw consent to the processing of personal data at any time in writing at the address of the Organiser's registered office.


Information on the Possibility and Conditions of Dispute Resolution through the Alternative Dispute Resolution System


In the event that the Buyer – consumer was not satisfied with the handling of a complaint by the Organiser, or when the Buyer – consumer contacted the Organiser with a request for remedy and was not satisfied with the manner in which the Organiser handled their complaint, or if they believe that the Organiser has violated their rights, the Buyer – consumer has the right to contact the Organiser with a request for remedy. If the Organiser responds to such a request negatively or does not respond within 30 days from the date of its dispatch, the Buyer – consumer has the right to submit a proposal for the initiation of alternative dispute resolution to an alternative dispute resolution entity. The alternative dispute resolution entity is the Slovak Trade Inspection, Prievozská 32, P.O. Box 5, 820 07 Bratislava 27, or another relevant authorised legal entity registered in the list of alternative dispute resolution entities maintained by the Ministry of Economy of the Slovak Republic (the list is available at www.mhsr.sk). The Buyer – consumer is entitled to choose the alternative dispute resolution entity to which they will turn. The consumer may use the online dispute resolution platform to submit a proposal for alternative resolution of their dispute, which is available at http://ec.europa.eu/consumers/odr/.


Final Provisions


The Organiser is entitled to amend and supplement these terms and conditions. The Organiser is obliged to publish the amended terms and conditions on its website www.lovestream.sk no later than the effective date of the amendment.

The relevant legal regulations, in particular the Consumer Protection Act, the Civil Code and others, shall apply subsidiarily to legal relations related to the sale of tickets for the event.

These TC become effective on 01.10.2024.
